Terms of Service

These terms govern your use of Tracken. By creating an account or using the service, you agree to them.

1. Who we are

Tracken is operated by Tracken Technologies OÜ, a private limited company registered in the Estonian Business Register under code 17490505, with its registered seat in the Republic of Estonia ("Tracken", "we", "us").

Throughout these Terms, "you" refers to the natural or legal person who creates a Tracken account or accesses the service. You can reach us at info@tracken.ee.

2. The service

Tracken is a web-based application that lets you import bank statements, classify transactions, and analyse personal or household finances. The service is provided on a software-as-a-service basis at tracken.ee and any related sub-domains.

We continuously develop the service. Features may be added, modified, or removed; we will not materially reduce the functionality you paid for during a billing period without giving you notice and a reasonable remedy.

3. Account and eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract. You are responsible for keeping your login credentials confidential and for all activity on your account.

Notify us immediately at info@tracken.ee if you suspect unauthorised access. You may close your account at any time from Settings → Profile.

4. Acceptable use

You agree not to: (a) attempt to access data belonging to other users; (b) reverse engineer, scrape, or overload the service; (c) upload illegal content or content you do not have the right to upload; (d) use Tracken to violate any law or third-party right.

We may suspend or terminate accounts that we reasonably believe violate these rules, with notice where practical.

5. Plans, trial, and billing

Paid plans include a 14-day free trial that begins when you start the trial. No payment is required to begin the trial, and you may cancel at any time before it ends at no charge.

After the trial, the plan automatically converts to a paid subscription unless cancelled. Subscriptions renew on the cadence shown at checkout (monthly or yearly) until you cancel.

Payments are processed by Paddle.com Market Limited ("Paddle"), our merchant of record. Paddle handles checkout, invoicing, sales tax / VAT, and payment compliance. Your purchase is governed by Paddle's customer terms in addition to ours.

6. Cancellation and refunds

You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; you retain access until then.

We offer a 14-day money-back guarantee on paid plans, in addition to any statutory withdrawal rights you may have. Refund details and the process are described in our Refund Policy.

7. Your data

You retain ownership of the bank statements, transactions, categories, rules, and other content you upload ("Customer Data"). You grant Tracken a limited licence to host, process, and display Customer Data solely to provide the service to you.

How we process personal data is described in our Privacy Policy.

8. Intellectual property

Tracken, the Tracken word mark, the Tracken logo, the application code, and the user interface are owned by Tracken Technologies OÜ and are protected by copyright and other intellectual property laws.

These Terms do not grant you any rights to our trademarks or branding beyond what is necessary to use the service.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. The service is provided on an "as available" basis. We may perform maintenance or apply updates that briefly affect availability.

We are not liable for downtime caused by third-party providers (hosting, payments, email) beyond our reasonable control.

10. Liability

To the extent permitted by law, our aggregate liability under these Terms is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or loss of goodwill.

Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protections.

11. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your account for material breach of these Terms or for unlawful activity. On termination, your access ends and your data is deleted in accordance with our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. When changes are material, we will notify you by email or in-product notice at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws principles. Mandatory consumer protections of your country of residence remain unaffected.

Any dispute arising out of or in connection with these Terms shall be resolved by Harju County Court (Harju Maakohus) in Tallinn, Estonia, except where a different forum is mandatory under EU consumer law.
